What’s different about refinancing a car loan in Colorado
Vehicle titles in Colorado are issued by the Colorado Department of Revenue, Division of Motor Vehicles (DMV).
Colorado law directs a lienholder to release a paid-off vehicle lien within fifteen calendar days after the lien is paid and satisfied, unless the lienholder can show extenuating circumstances, and any person aggrieved by a violation may bring a civil action in court to compel compliance and recover damages arising from the violation.
Vehicle liens in Colorado are not perfected through ordinary Uniform Commercial Code filings. A mortgage, or the refinancing of a mortgage, intended by the parties to create a lien on a motor vehicle must be filed for public record, and the department or its authorized agent notes that filing on the owner's certificate of title.
After a consumer credit default consisting only of a missed payment, a Colorado creditor may neither accelerate the unpaid balance nor take possession of the collateral until twenty days after giving the consumer a written notice of the right to cure; tendering all unpaid sums then due restores the consumer's rights under the agreement as though the default had not occurred.
After default a secured party in Colorado may take possession of the collateral either pursuant to judicial process or without judicial process, but a self-help repossession carried out without going to court is lawful only if the secured party proceeds without a breach of the peace.
A Colorado debtor may redeem repossessed collateral by tendering fulfillment of all obligations secured by it plus the secured party's reasonable expenses and reasonable attorney fees, at any time before the secured party disposes of the collateral, contracts to dispose of it, or accepts it in satisfaction of the debt; in a consumer-goods transaction this redemption right cannot be waived.
Subject to the statutory rebate rules that apply to precomputed transactions, a Colorado consumer may prepay the unpaid balance of a consumer credit transaction in full at any time without penalty, which is the mechanism that lets an existing auto loan be paid off early when a refinance funds.
