What’s different about refinancing a car loan in Ohio
Vehicle titles in Ohio are issued by the Ohio Bureau of Motor Vehicles (Ohio Department of Public Safety) — certificates of title are issued through clerks of the courts of common pleas using the BMV's automated title processing system.
When an Ohio car loan is paid off, the lienholder must note the discharge and convey the certificate of title, or a separate statement discharging the security interest, to a clerk of courts within seven business days after good funds in the correct amount to fully discharge the security interest have been credited.
Ohio titles can exist purely electronically. When a title application is submitted electronically the clerk issues an electronic certificate of title unless the applicant requests a physical one, and a secured party may specifically ask the clerk not to print a physical certificate at all, so a refinancing borrower may never hold paper.
Under Ohio's retail installment sales law, a secured party that repossesses collateral securing a consumer transaction must send the debtor an itemized notice of the default and the amount required to cure within five business days after taking possession, and this cure right may not be exercised more than once for a single debt.
Ohio law lets a debtor, any secondary obligor, or another secured party or lienholder redeem repossessed collateral by fulfilling all obligations secured by it plus reasonable expenses and attorney's fees, but only before the secured party has disposed of it, contracted for its disposition, or accepted it in satisfaction of the debt.
Before selling repossessed collateral in an Ohio consumer transaction, the secured party must send notice of the time, place, and minimum price by certified mail with return receipt requested at least ten days before the sale, together with a statement that the debtor may be held liable for any resulting deficiency.
In an Ohio consumer-goods transaction the secured party must send the debtor a written explanation of how any surplus or deficiency was calculated, either when it accounts for a surplus or first makes written demand after the disposition, or within fourteen days after receiving a request for that explanation.
