Vehicle titles in West Virginia are issued by the West Virginia Division of Motor Vehicles (WV DMV), West Virginia Department of Transportation.

  • When a West Virginia owner places a new lien on a vehicle that is already titled, as happens in a refinance, the lien must be recorded with the Division of Motor Vehicles and shown on the certificate of title, and competing liens rank in the order of their filing according to the date, hour and minute the division receives each application.

  • Once a West Virginia vehicle lien has been paid and satisfied, the lienholder must execute a release or surrender the certificate of title to the person legally entitled to it within fifteen days, and refusing or failing to do so is unlawful and constitutes a misdemeanor under the statute, whether the title was held electronically or on paper.

  • West Virginia authorizes an electronic lien and title system: the division may transmit liens electronically to the first lienholder, and beginning July 1, 2025 all financial institutions recording five or more liens in a calendar year must use the division's electronic lien and title system for all lien actions, though a person may still request a paper certificate of title.

  • Before accelerating the unpaid balance, commencing an action, demanding payment, or taking possession of collateral after a consumer default, a West Virginia creditor must give written notice of the consumer's right to cure and wait ten days; a timely tender of the unpaid sums then due, without acceleration, plus unpaid delinquency or deferral charges, restores the consumer's rights.

  • A secured party that disposes of repossessed collateral must first send a reasonable authenticated notification of disposition to the debtor and to any secondary obligor, unless the collateral is perishable, threatens to decline speedily in value, or is of a type customarily sold on a recognized market, which a financed passenger vehicle ordinarily is not.

  • A debtor, any secondary obligor, or another secured party or lienholder may redeem repossessed collateral by tendering fulfillment of all obligations the collateral secures together with the secured party's reasonable expenses and attorney's fees, but only before the secured party collects the collateral, disposes of it or contracts for its disposition, or accepts it in satisfaction of the obligation.
