What’s different about refinancing a car loan in Illinois
Vehicle titles in Illinois are issued by the Illinois Secretary of State.
In Illinois a lienholder holding the certificate of title must execute a release of its security interest and mail or deliver the certificate and release to the next lienholder, or if there is none to the owner, within twenty-one days after receiving payment that satisfies the loan, shortened to ten business days when the payoff is made by cash, a cashier's check, or a certified check.

A lienholder named on an Illinois certificate of title must, upon written request from the vehicle owner or from another lienholder named on that same certificate, disclose pertinent information about its security agreement and the indebtedness that agreement secures, which is the statutory route a borrower or a prospective new lender uses to obtain documented payoff information before a refinance.

Under the Illinois Motor Vehicle Retail Installment Sales Act a retail buyer may prepay the contract in full at any time before maturity and must receive a refund credit of unearned finance charge calculated under the statutory proportional formula, and this right applies notwithstanding any provision in the retail installment contract to the contrary.
After a default, an Illinois secured party may take possession of the vehicle either through judicial process or without judicial process, but only if it proceeds without breach of the peace, and it may also require the debtor to assemble the collateral and make it available at a place reasonably convenient to both parties.
Before disposing of a repossessed vehicle the secured party must send the debtor and any secondary obligor a reasonable signed notification of disposition, and in a consumer-goods transaction that notice must additionally describe any liability for a deficiency of the person receiving it and give a telephone number from which the amount required to redeem the collateral is available.
A debtor, any secondary obligor, or any other secured party or lienholder may redeem the vehicle at any time before the secured party has collected the collateral, has disposed of it or contracted for its disposition, or has accepted it in full or partial satisfaction, and redemption requires fulfillment of all obligations secured plus the secured party's reasonable expenses and attorney's fees.
