What’s different about refinancing a car loan in New Mexico
Vehicle titles in New Mexico are issued by the New Mexico Motor Vehicle Division (MVD), New Mexico Taxation and Revenue Department, which records and releases liens on paper titles. That is worth knowing because a paper lien release adds mailing time between your old lender and your new one.
When a New Mexico certificate of title shows a lien and the vehicle is transferred to a new owner or a name is changed, the lien must first be properly released; the lien holder can do that by endorsing the designated release area on the outstanding certificate of title, by completing MVD Form 10041 Release of Lien, or by a notarized release on the lien holder's letterhead.

A lien on a New Mexico vehicle is perfected when the title application is filed with the division and a new certificate of title is issued; if the division receives that application within ten days after the security agreement was executed, constructive notice relates back to the execution date and the lien has priority over liens attaching or filed afterward.

If the owners' names on a New Mexico certificate of title are joined by the word or, only one signature is required to apply for, assign, or encumber the vehicle; if the names are joined by the word and, both owners must sign the title application to assign or to encumber that vehicle.
A New Mexico transfer of equity is an inter-party agreement between the registered owner, the person who will take over the loan payments, and the lienholder, and it allows title to be transferred to a new owner subject to an existing loan with the lender's agreement; the Change of Equity Certification form (MVD-10044) is generally used in lieu of both the bill of sale and the release of lien, because the lienholder is itself a party to the transaction.

New Mexico accepts vehicle titles from all states that are accompanied by repossession documents for transfer and registration without requiring the repossessor to title the vehicle in their own name before resale, and the lien holder reflected on the title must sign a release of lien before that title can be transferred; the repossessor must also submit an Affidavit of Repossession, MVD Form 10012.
