Vehicle titles in Rhode Island are issued by the Rhode Island Division of Motor Vehicles (Rhode Island Department of Revenue).

  • When a Rhode Island owner grants a new security interest on a vehicle that already has a certificate of title, the owner must promptly execute an application naming the new lienholder, its address and the date of the security agreement, then deliver the certificate, the application and the registration card to that lienholder, who forwards them to the Division of Motor Vehicles for endorsement or reissue.

  • Once a security interest is satisfied and the lienholder holds the Rhode Island certificate of title, that lienholder must execute a release of its security interest within fifteen business days and deliver it to the next lienholder named on the certificate, to the owner, or to any person presenting written authorization from the owner; a lienholder that fails to do so is liable for damages caused by the failure.

  • The Rhode Island DMV states that the state does not require a person to apply for a new certificate of title once a lien has been satisfied; Rhode Island only requires the lien to be released by the lienholder signing off on the title or providing a letter of lien release to attach to it, though a lien-free title in the owner's name does require an application with an original lien release.

  • Under the Rhode Island Automobile Repossession Act a secured party must first send the consumer a written notice, by certified mail with return receipt requested or by first-class mail to the consumer's last known address, conspicuously stating the right to cure and allowing at least twenty-one days after delivery to pay the unpaid sums due; a consumer may cure only once in any twelve-month period.

  • If a Rhode Island automobile is repossessed, the secured party may take possession only without a breach of the peace, must notify the police department of the city or town where the repossession occurred, and the consumer has twenty days from the taking of possession to redeem the automobile and reinstate the loan or lease agreement before it may be disposed of.

  • After a repossessed vehicle is disposed of in a Rhode Island consumer-goods transaction, the secured party must send the debtor a written explanation showing how any surplus or deficiency was calculated, either before or when it accounts to the debtor and pays a surplus or first demands payment of a deficiency, or within fourteen days after receiving the debtor's request for that explanation.
